Tanggung Jawab Rumah Sakit dalam Perlindungan Hukum bagi Pasien dan Tenaga Medis

Abstract

This study explores the form and scope of hospital responsibility in providing legal protection for both patients and medical personnel, employing a literature review approach. Drawing upon Law Number 44 of 2009 on Hospitals and Law Number 17 of 2023 on Health, hospitals are held legally accountable for any losses resulting from negligence or violations of service standards by healthcare professionals or the institution itself. Legal protection for patients encompasses the right to quality healthcare, access to medical information, and compensation for harm caused by substandard medical practices. Simultaneously, legal protection for medical personnel is ensured through workplace safety measures, access to legal assistance, and protection when carrying out duties in accordance with professional standards and operational protocols. The findings highlight the need for enhanced risk management and legal compliance frameworks within hospitals to ensure equitable, safe, and accountable healthcare services for all stakeholders. This study contributes to the discourse on healthcare law by clarifying the dual responsibility of hospitals in protecting both patients and medical personnel. It offers a comprehensive legal perspective that can inform policy development, improve hospital governance, and strengthen the legal infrastructure supporting patient rights and professional protections in Indonesia's healthcare system.
