Kedudukan Lembaga-Lembaga Negara Independen dalam Struktur Ketatanegaraan Indonesia
Abstract
This study aims to analyze the position of independent state institutions within the constitutional structure of Indonesia, as well as to examine their strategic roles in supporting a democratic and accountable system of governance. The research employs a normative juridical approach with qualitative analysis based on statutory regulations, official documents, and literature studies related to constitutional practices.The findings indicate that independent state institutions such as the Corruption Eradication Commission (KPK), the General Elections Commission (KPU), and the National Human Rights Commission (Komnas HAM) play a vital role as checks and balances mechanisms beyond the traditional trias politica. Although not always explicitly stipulated in the 1945 Constitution (UUD 1945), their existence and legitimacy are reinforced through derivative regulations and constitutional practices. These institutions function to uphold transparency, professionalism, and accountability in state administration with a high degree of independence.However, in practice, independent state institutions face serious challenges such as overlapping authorities, political interference, and limited resources. Therefore, strengthening their legal status and institutional capacity is an urgent necessity to ensure their effectiveness and sustainability in Indonesia's modern constitutional system, which must be responsive to the dynamics of the times.
