Pertanggung Jawaban Pidana terhadap Tindak Pidana Pemilu pada Pemilu Serentak Tahun 2024 Di Kabupaten Bima
Abstract
The objective of this study is to analyze the enforcement mechanisms of criminal law in relation to electoral crimes during the 2024 simultaneous elections in Bima Regency, and to identify the obstacles in the application of criminal liability against perpetrators of electoral crimes in the 2024 simultaneous elections. This research adopts a normative legal approach, also known as doctrinal research, utilizing a library or document study method. The findings indicate that the mechanism for criminal law enforcement is regulated under Law Number 7 of 2017, specifically detailed in Articles 488 to 554, which address the procedures for handling electoral law violations. In Bima Regency, reports of violations only reach the Election Supervisory Agency (Bawaslu). Although there were several electoral violations recorded and reported by Bawaslu, none progressed to the stage of electoral criminal offense (tipilu) prosecution, despite dozens of cases being handled. The obstacles identified include weaknesses in electoral law enforcement, the difficulty in proving electoral crimes, the ineffectiveness of criminal sanctions, and inadequate protection for witnesses and whistleblowers.
