Analisis Hukum Islam dan Hukum Positif di Indonesia terhadap Status Nasab dan Hak Perwalian Anak terhadap Perkawinan Beda Agama

Abstract

This study examines how the status of lineage and guardianship rights of children born from interfaith marriages are positioned within the framework of Islamic law and positive law in Indonesia, particularly in Purbolinggo Village. The phenomenon of interfaith marriage presents complex legal issues, especially regarding the recognition of lineage, guardianship rights, the religious identity of children, and legal protection, which are often inconsistent between Islamic law and positive law in Indonesia. This study uses a qualitative approach with socio-legal and normative juridical methods, combining an analysis of fiqh rules and social practices in the community. The results of the study show that there is a dualism of legal status where, under positive law, interfaith marriages can be recognised through court decisions and official registration, but under Islamic law, such marriages are considered invalid, so that the parentage of children to non-Muslim fathers is not recognised. In practice, Muslim mothers generally dominate in terms of guardianship and religious education rights for children. This study emphasises the need for a harmonious and equitable legal framework that can guarantee the best interests of children in accordance with the principles of maqashid syariah and human rights. This study also highlights the dynamics of law implementation and child rights protection in the context of religious plurality in Indonesia.
