Peran Etika Hakim Konstitusi dalam Menjaga Independen dan Integritas Putusan Mahkamah Konstitusi

Abstract

The Constitutional Court plays a crucial role in upholding constitutional supremacy and maintaining democratic order in Indonesia. The independence and integrity of constitutional judges are fundamental to ensuring the legitimacy and moral authority of the Court's decisions. This article explores the role of judicial ethics in safeguarding the neutrality of the Constitutional Court and its impact on public trust. Using a normative legal approach supported by case analysis of ethical violations, this study finds that while the code of ethics serves as a formal guide, its enforcement faces challenges due to weak internal supervision and lack of a strong ethical culture. Ethical breaches involving constitutional judges not only undermine personal credibility but also erode institutional legitimacy. To address these challenges, the strengthening of the Constitutional Court's Ethics Council, the promotion of transparency, and the involvement of civil society in oversight mechanisms are essential. Ultimately, this article argues that ethics must be integrated as a core value in constitutional adjudication to maintain public confidence and reinforce the rule of law.
