Ulang Regulasi: Menempatkan Hak Terbaik Anak di Garda Terdepan
Abstract
Children are legal subjects and members of a vulnerable group whose rights must be guaranteed, protected, and fulfilled by the state. Within the child protection system, the principle of the "best interests of the child" serves as the paramount principle, positioning the child's interests as a fundamental consideration in the formulation of regulations and policies, as well as in legal decision-making. This principle is recognized in international legal instruments—notably the Convention on the Rights of the Child—and is reflected in various national legal instruments governing child protection. However, the status of this principle within the Indonesian legal system requires further in-depth analysis, as its provisions are scattered across various regulations and lack full, harmonious integration. The multitude of rules governing child protection risks creating regulatory overlaps, conflicting interpretations, and weak implementation if they are not grounded in a human rights perspective. Therefore, this research is crucial for analyzing the status of the "best interests of the child" principle in both national and international legal instruments, while also formulating a direction to strengthen child protection regulations so that they become more integrated, responsive, and equitable. In this way, child protection will transcend mere normativity and truly serve as a foundation for state law and policy, thereby safeguarding the growth, development, and future of Indonesian children.
