Problematika Pelaksanaan Peran Advokat dalam Pemenuhan Hak Atas Bantuan Hukum bagi Masyarakat Kurang Mampu di Kabupaten Sukoharjo
Abstract
Access to legal aid is an essential component of access to justice, particularly for economically disadvantaged communities who face financial, informational, and procedural barriers when dealing with legal problems. This study examines the implementation of advocates’ roles in fulfilling the right to legal aid for economically disadvantaged communities in Sukoharjo Regency, Indonesia, identifies the main obstacles encountered in its implementation, and analyzes strategies for strengthening advocates’ roles in improving access to justice. This research employs empirical legal research with a qualitative approach. Data were obtained through semi-structured interviews with 15 informants consisting of eight advocates, five economically disadvantaged community members, and two legal aid organizations. Secondary data were collected from relevant legislation, legal literature, and institutional documents. The data were analyzed through thematic coding, categorization, and source and method triangulation. The findings indicate that advocates play important roles through legal consultation, assistance, representation, and administrative support. However, the implementation of legal aid remains affected by limited legal literacy, insufficient knowledge of legal aid rights, administrative requirements, resource constraints, financing issues, and coordination challenges among relevant institutions. The study conceptually demonstrates that access to justice should be understood as a continuous process beginning with legal awareness and access to service information, followed by administrative assistance, legal representation, institutional coordination, and the effective use of legal mechanisms. Strengthening these interconnected elements is necessary to make legal aid more accessible, responsive, and sustainable for economically disadvantaged communities.
