Perlindungan Hukum terhadap Konsumen atas Pemotongan Saldo OVO pada Transaksi GRAB-Food yang Tidak Selesai
Abstract
This study aims to determine and analyze the legal protection of consumers using GRAB-Food services who make payments using OVO balances for incomplete transactions and how to regulate legal remedies that can be taken by users for default actions. This study used a normative method, namely data obtained from primary legal materials, secondary legal materials and tertiary legal materials and then processed qualitatively in order to provide answers or solutions to problems to draw a conclusion. Based on the results of the study, firstly, there are two forms of legal protection for consumers who are harmed by deducting OVO balances for transactions that are not completed by GRAB drivers, the first is preventive legal protection, and the second is legal protection for consumers who are harmed by deducting OVO balances for transactions. What are not resolved by GRAB drivers, both preventive legal protection and repressive legal protection are considered not optimal in providing protection to victims who are harmed due to OVO balance deductions, because so far there is no law that specifically regulates legal protection for e-money users (electronic money) or in a more detailed manner, regulates consumer protection, especially in cutting balances in electronic transactions. Second, legal remedies that can be taken by consumers who are harmed as a result of deducting OVO balances for incomplete transactions can be carried out in two ways, the first by means of litigation (through the courts). The second is by non-litigation. The recommendation of this research is that in order to achieve legal protection for consumers using e-commerce, especially for users of the GRAB-Food application, more specific regulations are needed to regulate the protection of e-commerce users. And the government must regulate more specifically regarding dispute resolution or e-commerce cases.
