Charismatic Leadership dan Demokrasi Substantif dalam Studi Faksi Politik Pasca Reformasi di Negara Hukum Indonesia

Abstract

Political factions are a problem that has occurred in various periodisations of government and party systems in Indonesia. The existence of factions has led to an internal conflict within political parties, namely differences in orientation from the vision and mission of the party in general will encourage division based on sectoral interests. This paper will analyse the strengthening of factions and internal conflicts of political parties in the reform era from the perspective of political idealism and pragmatism. The method of writing this article uses a library research model, with a normative approach. The results of the research show that faction dynamics are natural in the life of democracy due to diverse currents of view or political paradigms. As a result, the strengthening of factions in Indonesia leads to competitive and degenerative patterns that hamper the achievement of substantive democratic goals, not only orientation to practical politics, but the rule of law, political education and means of aspiration and national development are the juridical responsibilities of the party. This is influenced by the still strong character paradigm based on charismatic principles, which will hamper the orientation towards substantive democracy. On the other hand, the existence of an internal party court has not been able to provide certainty and effectiveness in resolving party conflicts, so the need for a party court under the auspices of the general court becomes a ius constituendum that needs to be considered
