Harmonisasi Peraturan Daerah terhadap Peraturan Perundang-Undangan Ditingkat Pusat
Abstract
The purpose of harmonizing regional regulations with laws and regulations at the central level is to organize regional regulations so that they do not conflict with laws and regulations at the central level, the number and types of which are quite large, and so that there is no disharmony between laws and regulations in the regions themselves, and are always in line with the spirit of Pancasila and the 1945 Constitution of the Republic of Indonesia. However, the current regulations related to the harmonization of regional regulations actually obscure harmonization at the implementation level. Regulations on harmonization have not been able to produce legal certainty in accordance with the principles in the formation of laws and regulations. Many regional regulations have been canceled through material tests by executive and judicial institutions. The Supreme Court is a sign of a problem that is a challenge for the arrangement of laws and regulations. Therefore, this study focuses on First, the factors causing disharmony of regional regulations with laws and regulations at the central level. Second, how is the ideal harmonization of regional regulations. This study uses a normative legal research method, namely research using literature studies to examine the doctrines, principles and legal principles outlined in laws and regulations related to the formation of laws and regulations. Research on the provisions of Article 58 of Law 12 of 2011 concerning the Formation of Laws and Regulations which is the legal basis for harmonization, rounding and strengthening the concept of draft regional regulations requires affirmation. This affirmation is needed so that it gives rise to an Imperative nature. Law 12 of 2011 concerning the Formation of Laws and Regulations has undergone several changes. The harmonization mechanism must be explicitly stated as part of the process of forming laws and regulations. In theoretical terms, it is very possible to harmonize, round up
