Penyelesaian Perkara Pencemaran Nama Baik Secara Restorative Justice
Abstract
The legal certainty of the ITE Law related to the settlement of criminal defamation cases today can be resolved through the Restorative Justice approach or general justice through the court process. The concept of the restorative justice approach emphasizes the approach to the conditions for creating justice and balance for the perpetrators of the crime and the victims themselves. In criminal defamation through social media, the implementation of the ultimum remedium principle needs to be maximized, because basically the loss lies in the reputation, so that with the restorative justice approach, compensation suffered by the victim can be formulated with the restoration of dignity and honor properly and correctly. This research is a normative research that uses legal and non-legal materials as data sources and the approach taken is the statutory regulatory approach and the conceptual approach. To find out how Indonesian positive law regulates restorative justice, a comprehensive study of related regulations is needed. The results of this study confirm that the restorative justice approach can balance the protection of a person's dignity and honor and protection of freedom of expression or prevent criminalization of defamation cases.
