Abstract

The purpose of employment development is to create a prosperous society and for the prosperity of the people. So is the Job Creation Law. Since its inception, namely Law No. 11 of 2020 concerning Job Creation, several judicial reviews have been carried out by the community, especially by workers/laborers. In November 2022, the Constitutional Court decided on case No. 91/PUU-XVIII/2020, the Constitutional Court stated that the Job Creation Law did not have conditional binding legal force. In response to the Court's decision, the government in 2022 responded to the Constitutional Court's decision by issuing PERPPU No. 02 of 2022, which was then stipulated as Law No. 06 of 2023 to become the Job Creation Law. It didn't stop there and in October 2024 the Constitutional Court decided on Case No. 168/PUU-XXI/2023, which in essence the Constitutional Court granted part of the Judicial request Review from the Labor Party, Metal Workers Union, SPSI and SPMI. One of the things requested by the Applicants is related to the PKWT work agreement. The PKWT provisions in the Job Creation Law are considered detrimental to workers/laborers, where the PKWT provisions in the Job Creation Law do not limit the types of work that can be done with the PKWT system and the validity period of the PKWT is quite long.
