Analisis Hukum Pengaturan Izin Usaha dalam Pemerintahan Daerah di Indonesia

Abstract

The purpose of this study is to analyze the legal basis, dynamics of implementation, and challenges in managing business permits at the regional level. With a normative and empirical approach, this study highlights regional governments in granting business permits based on the principle of regional autonomy and its synergy with national regulations. The results of the study indicate that although regional autonomy provides broad authority to regional governments, there are still various administrative and coordination obstacles that affect the effectiveness of business licensing. Therefore, a more harmonious policy is needed between the central and regional governments in order to create a more efficient and transparent licensing system.Although policy reforms through the Job Creation Law and the implementation of the Online Single Submission (OSS) have been carried out to improve licensing efficiency, its implementation at the regional level still faces various challenges. Some of the main obstacles found include the bureaucracy that is still complicated, the lack of harmonization between central and regional regulations, limited human resources (HR) in understanding the new system, and the continued practice of maladministration in issuing permits. In addition, the authority of officials in issuing permits must also be based on the principle of legality so that the decisions taken have a strong legal basis and do not conflict with the principle of legal certainty.
