Dinamika Hukum Waris pada Masyarakat Pesisir Madura: Antara Syariat dan Tradisi

Abstract

In this study, we examine the application of inheritance law in Madura's coastal communities, particularly in Patereman Village, where Islamic law (sharia) and customary law clash. Participant observation and in-depth interviews were used in this study's qualitative research. This study sought to understand the community's perceptions of the two legal systems and how they resolve inheritance disputes in day-to-day interactions. The findings demonstrate that, despite the Madurese community's strong Muslim affiliation, traditional values that are passed down through the generations continue to have an impact on the practice of inheritance distribution. This phenomenon illustrates how the social structure of society continues to debate between Islamic and Madurese identities
