Ketentuan Kemampuan Finansial Sebagai Salah Satu Syarat Permohonan Poligami Perspektif Hakim Pengadilan Agama Surakarta
Abstract
This study examines polygamy, a legal issue that frequently sparks debate in Indonesian society. Although it is permitted under Islamic law and regulated by the Marriage Law, the practice of polygamy requires fulfillment of certain conditions, one of which is the husband’s financial capability. This research aims to analyze how judges at the Surakarta Religious Court interpret and establish financial requirements in polygamy applications. The research method used is qualitative, with a normative juridical and case study approach. Data were collected through interviews with judges and through an analysis of legal considerations in decisions related to polygamy applications.The findings show that judges take into account factors such as regular income, asset ownership, separation of assets with the first wife, and witness testimonies when assessing the financial capability of the applicant. The standard for financial capability is relative and adjusted to the family’s economic conditions and the applicant’s local environment.This study found that there is no legal provision that sets a specific nominal threshold, thereby granting judges full discretion in determining the financial eligibility of the applicant.
