Analisis Yuridis Intervensi Orang Tua Sebagai Faktor Penyebab Perceraian (Studi Putusan Pengadilan Agama Demak Nomor : 551/Pdt.G/2023/Pa.Dmk)
Abstract
This study aims to examine the views of the Panel of Judges of the Demak Religious Court on parental intervention as a factor causing divorce in the divorce case Number: 551/Pdt.G/2023/PA.Dmk, and to analyze the decision reached from an Islamic law perspective. This case reflects a social phenomenon where excessive parental involvement in the child's household life can trigger disharmony and prolonged conflict that ultimately ends in divorce. Using a qualitative normative legal research method through a case study approach, this study examines legal considerations in court decisions and their relevance to Islamic law principles. The results of the study show that parental intervention makes a significant contribution to the breakdown of husband and wife relationships, and this is one of the bases considered by the Panel of Judges in granting a divorce application. From an Islamic law perspective, the involvement of a third party that causes harm in the household can be used as a sharia reason for divorce, because Islam allows divorce as a last resort when household life no longer provides benefits and peace for the couple.
