Indigenous Knowledge as a Living Laboratory: Reconceptualizing Local Wisdom-Based Science Learning Strategies

Abstract

This study examines land dispute resolution through two alternative methods: arbitration and mediation, focusing on their practical application and effectiveness. The approach used is a normative juridical study to understand the legal basis, as well as a practical analysis based on case studies and the parties' experiences. The findings indicate that arbitration provides a binding and final decision, suitable for disputes requiring legal certainty, although the process is relatively formal and requires more time and costs. In contrast, mediation emphasizes amicable resolution with a faster and more flexible negotiation approach, but the outcome depends on mutual agreement, which is not always legally binding. This study emphasizes the importance of selecting a dispute resolution method that suits the characteristics of the dispute and the parties' preferences to achieve an effective and sustainable resolution.
